President Biden’s Executive Order on AI – Part 2



Hello, and welcome to LegalEase. Today, we will finish our discussion regarding the Executive Order signed by President Biden on the use of Artificial Intelligence, otherwise known as AI.

In our prior segment, we discussed how the President uses an Executive Order to manage federal agencies. We also discussed the guiding principles of President Biden’s Executive Order on Artificial Intelligence.

Today, I want to discuss what each federal agency has been directed to do to address the privacy and safety of AI. President Biden has said he wants “a whole of government approach” to AI.  

  • Let’s start with the Department of Labor. The Department of Labor has been directed to address discrimination in the workplace and worker displacement. That’s a big one. Will we still have jobs after AI is implemented?
  • The Council on Economic Advisors has been directed to issue a report regarding the potential impact of AI on the labor force.
  • The Department of Justice has been directed to work with all federal civil rights agencies to make sure that AI is not used to discriminate against workers in the workplace. We recently talked about the first lawsuit that the EEOC filed against a company that was using AI to discriminate against older workers, and so we want to make sure that doesn’t happen.
  • The National Science Foundation has been directed to work on AI-related education and workforce development.
  • The Federal Trade Commission will consider if its current powers can be used to make sure that we have a fair marketplace regarding the development of AI. Is it fair for everybody? Do we have fair competition in the marketplace? Can you develop AI and put it in the marketplace fairly without undue burden from the big companies?
  • Finally, President Biden created a White House AI Council that has been directed to coordinate all the efforts by the different federal agencies  and to ensure they are compliant.

When will these mandates go into effect? The Executive Order on AI  is already effective, but the government agencies have anywhere between 30 days and one year to comply.

Who is impacted by the Executive Order? It primarily pertains to federal employers. However, it can also trickle over to the private sector, especially, if the private company supplies the federal government with services or products. Private employers are encouraged to stay abreast of the new rules and regulations.
