Updated EEOC Anti-Harassment Guidance


Hello and welcome to LegalEase. Today, I would like to talk about the updated harassment policies we expect the EEOC to issue this year – 2024.

Of course, the policies have not been issued yet, but the EEOC has already requested comments and given us an idea about why they plan to update their harassment guidance. It looks like the EEOC wants to clarify a few issues  for employers that pertain to preventing harassment in the workplace.

A couple of those issues pertain to employer investigations of harassment complaints – the EEOC wants to make sure employers understand how to conduct harassment complaints, how quickly they should take corrective action – I can tell you that one; promptly, and the EEOC wants employers to have basic guidelines for conducting workplace investigations. The EEOC also wants to make sure that employers understand that anti-harassment will include sexual orientation and gender identity and how those are expressed by individual employees. The EEOC is also going to issue new basic policy templates that employers can use in the workplace to help prohibit anti-harassment.

As soon as the updated policies come out from the EEOC, we will report to you and let you know what to expect.
